1. Introduction

Karminn EzyPro QHSE SAAS Services enable enterprises to meet their compliance to QHSE norms by effective auditing, monitoring improvements, quality indicators and KPI’s through our software as a service (SAAS) and network of management system professionals. Our Privacy Policy applies to any Subscriber (user) or Visitor to both on line and offline Services.

The entity who contracts our services (customers) assigns users to the portal and maintains full control

Registered users of a customer portal (“Subscribers”) share their organisational identities, engage with their organisation’s other users, exchange information, professional insights, post and view relevant content, learn and find out about business performance improvement opportunities. Content and data on some of the features are accessible to non-subscribers (“weblink user access”).

We use the term “Designated Countries” to refer to countries in the European Union (EU), European Economic Area (EEA), and Switzerland.

2. Services

This Privacy Policy, including our Cookie Policy applies to users of all our Services.

This Privacy Policy applies to EzyPro Management system solution, Ezypro Audit on the go, EzyProLite mobile app (“Services”), but excludes services that state that they are offered under a different privacy policy, example on site consultancy services.

3. Data Controllers and Contracting Parties

If you reside in the “Designated Countries”: or outside of the Designated Countries, the data controller is the entity that has contracted for the Karminn EzyPro SAAS service to which their authorised user or visitor is administered.

As a Visitor or subscriber of Karminn EzyPro Services, the collection, use and sharing of personal data is subject to this Privacy Policy (which includes our Cookie Policy and other documents referenced in this Privacy Policy) and it’s updates. Karminn EzyPro’s role is as a data processor.

4. Change

Karminn EzyPro (“we” or “us”) can modify this Privacy Policy, and if we make material changes to it, we will provide notice through our Services, or by other means, to provide you the opportunity to review the changes before they become effective. If you object to any changes, you may cancel your subscription.

You acknowledge that your continued use of our Services after we publish or send a notice about our changes to this Privacy Policy means that the collection, use and sharing of your personal data is subject to the updated Privacy Policy.

5.1 Data You Provide To Us

You provide data to create an account /user with us.

5.2 Registration

To create a subscription account, you need to provide data including about your organisation name, email address and/or mobile number, and a password. For making payments, You will need to provide payment details (e.g., credit card, bank information etc) and billing information.

You create your Karminn EzyPro portal profile (portal management section which helps you get the most from our Services) by providing the details asked for

You have choices about the information on your profile, It’s your choice whether to include sensitive information on your portal profile. Note none of the data provided is in public domain but will be visible to other users who given access to your portal by your site administrator.

6. Service Use

We log your visits and use of our Services, including from mobile apps.

We log usage data when you visit or otherwise use our Services, including within features, app and platform technology, such as when you view or click on content or perform a search, install or update one of our mobile apps. We use log-ins, cookies, device information and internet protocol (“IP”) addresses to identify you and log your use.

We collect data through cookies and similar technologies.

As further described in our Cookie Policy, we use cookies and similar technologies to recognize you and/or your device(s) on, off and across different Services and devices. 8. Your Device and Location

We receive data from your devices and networks, including location data.

When you visit or leave our Services, we receive the URL of both the site you came from and the one you go to next. We also get information about your IP address, proxy server, operating system, web browser and add-ons, device identifier and features, and/or ISP or your mobile carrier. If you use our Services from a mobile device, that device will send us data about your location based on your phone settings. We will ask you to opt-in before we use GPS or other tools to identify your precise location.

We collect information about you when you send, receive, or engage with messages in connection with our Services. For example, if you get an EzyPro action request or notification, we track whether you have acted on it and will send you reminders.

10. How We Use Your Data

We use your data to provide, support, personalize and develop our Services.

How we use your personal data will depend on which Services/features you use, how you use those Services and the choices you make in your role access policy which controlled by the portal site administartor. We use the data that we have about you to provide and personalize, including with the help of automated systems and inferences we make, our Services (no ads) so that they can be more relevant and useful to you and others.

Our Services help you connect with others in your organisation, Participate and share tasks and data to create organisational improvement opportunities, stay informed, get training and be more productive.

12. Stay Connected

Our Services allow you to stay in touch and up to date with colleagues, users, clients, suppliers and others provided access by your portal administrator.

It is your choice whether to assign someone to execute tasks using our Services, send assignment request, or invite new users or visitors. When you invite someone, the invitation email will be auto triggered which includes your name, and contact information. We will send invitation reminders to the person you invited.

13. Stay Informed

Our Services/features allow you to stay informed about news, events and ideas regarding management system topics you care about, and from colleagues you work with. Our Services also allow you to improve your professional outcomes or learn new ones. We use the data we have about you to notify others that you have updated your task, incident, posted a news, or uploaded a document.

14. Productivity

Our Services allow you to collaborate with colleagues, accomplish improvement actions and view dashboard data related to outcomes. Our Services/features allow you to communicate with other users and schedule and prepare meetings with them.

15. Communications

We contact you and enable communications between users We offer settings to control what messages you receive and how often you receive various types of messages.

We will contact you through email, mobile phone, notices posted on our websites or apps, messages to your Ezypro inbox, and other ways through our Services, including text messages and push notifications. We will send you messages about the availability of our Services, security, or other service-related issues. We also send messages about how to use the Services, feature updates, reminders. Please be aware that you cannot opt-out of receiving service messages from us, including security and legal notices as a user.

We develop our Services and conduct research in the area of management systems.

17. Service Development

We use data, including public feedback, to conduct research and development for the further development of our Services in order to provide you and others with a better, more intuitive and personalized experience, drive user engagement of our Services, and to enhance continuous improvement opportunity.

We may conduct Polls and surveys by us or others through our Services. You are not obligated to respond to polls or surveys, and you have choices about the information you provide. You may opt-out of survey invitations.

19. Customer Support

We use data to help you and fix problems.

We use the data (which can include your communications) to investigate, respond to and resolve complaints and Service issues (e.g., bugs).

We use data to generate aggregate insights.

We use your data to produce and share aggregated insights that do not reveal your identity. For example we may use your data to generate statistics about our feature utilization, or insights about usage topics, areas etc.

We use your data (including your communications) if we think it’s necessary for security purposes or to investigate possible fraud or other violations of our terms of service Agreement or this Privacy Policy and/or attempts to harm other users or Visitors to the portal you are associated with.

22. Enterprise Accounts

The portal access is in general controlled by Your, the enterprises portal site administrator and they may offer users and visitors access to our features and services using the role access policy. The enterprise reviews and manages your use of our portal Services.

23. Service Providers

We may use others to help us provide our Services (e.g., maintenance, analysis, audit, payments, fraud detection, marketing and development, on line training). They will have access to your information as reasonably necessary to perform these tasks on our behalf and are obligated not to disclose or use it for other purposes.

24. Legal Disclosures

We may need to share your data when we believe it’s required by law or to help protect the rights and safety of you, us or others.

It is possible that we will need to disclose information about you when required by law, subpoena, or other legal process or if we have a good faith belief that disclosure is reasonably necessary to (1) investigate, prevent, or take action regarding suspected or actual illegal activities or to assist government enforcement agencies; (2) enforce our agreements with you, (3) investigate and defend ourselves against any third-party claims or allegations, (4) protect the security or integrity of our Service (such as by sharing with companies facing similar threats); or (5) exercise or protect the rights and safety of LinkedIn, our Members, personnel, or others. We may dispute such demands when we believe, in our discretion, that the requests are overbroad, vague or lack proper authority, but we do not promise to challenge every demand.

We may share your data when our business is sold to others, but it must continue to be used in accordance with this Privacy Policy.

We keep some of your data even after you close your account.

We generally delete closed account information within 30 days of account closure, except as noted below.

We retain your personal data even after you have closed your account if reasonably necessary to comply with our legal obligations (including law enforcement requests), meet regulatory requirements, resolve disputes, maintain security, prevent fraud and abuse, enforce our User Agreement, or fulfil your request to “unsubscribe” from further messages from us. We will retain de-personalized information after your account has been closed.

The security of your Personal Information is important to us. Our service providers are required to maintain appropriate physical, technical and administrative safeguards to protect the security and confidentiality of the Personal Information you provide to us.

However, even the best security measures are not fool proof and we cannot guarantee that loss, misuse, unauthorized acquisition, or alteration of your data will not occur. We cannot ensure or warrant the security or confidentiality of the Personal Information you transmit to or receive from us by Internet or wireless connection, including email, phone, or SMS because we have no way of protecting that information that is out of our control.

We store and use your data outside your country.
